1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Saga Guild LLC ("we," "our," or "us"), a Minnesota limited liability company operating Recipe Heritage at recipeheritage.app (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify you of significant changes by email or prominent notice within the app.

2. Description of Service

Recipe Heritage is a web application that allows users to photograph handwritten recipe cards, transcribe them using artificial intelligence, store the resulting recipes in a personal digital library, and export recipes in various formats. The Service is offered in two tiers:

• Free tier: Up to 10 recipes, all core features included.
• Premium tier: Unlimited recipes, all features, for $7.00 USD per month.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.

4. Subscriptions and Billing

Subscription Terms

Recipe Heritage Premium is billed at $7.00 USD per month on a recurring basis. Your subscription begins on the date of purchase and renews automatically each month until cancelled.

Payment Processing

Payments are processed by Lemon Squeezy, our merchant of record. By subscribing, you authorize Lemon Squeezy to charge your payment method on a recurring monthly basis. Lemon Squeezy's terms and privacy policy govern the payment relationship.

Cancellation

You may cancel your subscription at any time through your Lemon Squeezy customer portal or by contacting us at mark.kolkmann@gmail.com. Upon cancellation, your Premium access will remain active through the end of your current billing period. You will not be charged for subsequent months.

Refunds

We offer a 7-day refund policy for new subscriptions. If you are not satisfied within the first 7 days of your initial subscription, contact us at mark.kolkmann@gmail.com for a full refund. Refunds are not provided for subsequent billing periods or for partial months after cancellation.

Price Changes

We reserve the right to change subscription pricing with at least 30 days advance notice sent to your registered email address. Price changes take effect on your next renewal date following the notice period.

5. Your Content

Ownership

You retain full ownership of all content you upload or create through the Service, including recipe card photographs and the recipes generated from them ("Your Content"). We claim no intellectual property rights over Your Content.

License to Us

By uploading content to the Service, you grant Saga Guild LLC a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete the content or close your account.

Your Responsibility

You represent that you have the right to upload any content you submit. You are solely responsible for Your Content and any consequences of sharing it.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Upload content you do not have the right to share
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or systematically extract data from the Service
• Use the Service for any commercial purpose other than your own personal recipe management
• Attempt to reverse engineer any part of the Service
• Upload malicious code, viruses, or harmful content

We reserve the right to suspend or terminate your account for violations of this section without prior notice.

7. AI-Generated Content

Recipe Heritage uses artificial intelligence to transcribe handwritten recipe cards. You acknowledge that:

• AI transcriptions may contain errors, omissions, or inaccuracies
• You are responsible for reviewing and correcting transcribed content before relying on it
• We make no guarantee that AI transcriptions will be complete or accurate
• Food safety decisions should not be made solely on the basis of AI-transcribed recipes

8. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Saga Guild LLC. The Recipe Heritage name, logo, and brand elements are trademarks of Saga Guild LLC. You may not use our trademarks without our prior written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

We are not responsible for the accuracy of AI-transcribed recipes. Always verify recipe ingredients, quantities, and instructions before preparing food, particularly when food allergies or dietary restrictions are a concern.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAGA GUILD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Saga Guild LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, Your Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms, with or without notice. You may close your account at any time by contacting us at mark.kolkmann@gmail.com.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Minnesota, and you consent to personal jurisdiction in those courts.
